General Terms and Conditions (GTC)

I. Scope of Application

These General Terms and Conditions (“GTC”) apply to all business relationships between Lux Relife / Owner: Monique Rezgui and its customers and sellers in the context of purchase, sale, and consignment transactions.

  1. The following General Terms and Conditions (GTC) apply in their version valid at the time of conclusion of the contract to all contracts between Lux Relife and consumers (Section 13 of the German Civil Code (BGB)) as well as businesses (Section 14 of the German Civil Code (BGB)).

  2. These GTC also apply to sellers who sell goods through Lux Relife on a consignment basis or as an open or undisclosed agent.

  3. Conflicting or deviating terms and conditions of the customer or seller are not recognized unless Lux Relife expressly agrees to their validity in writing.

II. Conclusion of the contract

  1. The products displayed in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.

  2. By completing the order process and clicking the corresponding button, the customer submits a binding offer to purchase the goods in the shopping cart.

  3. After receipt of the order, the customer receives an automatic order confirmation by email. This does not yet constitute acceptance of the offer.

  4. The contract is only concluded upon express acceptance by Lux Relife or upon shipment of the goods.

  5. Lux Relife reserves the right to refuse orders without giving reasons.

  6. The contract language is German/English.

III. Right of withdrawal for consumers/Cancellation policy

Consumers have a statutory right of withdrawal for online orders within 14 days.

The withdrawal period is 14 days from the day on which the customer or a third party designated by the customer receives the goods.

To exercise the right of withdrawal, the customer must inform Lux Relife of their decision by means of a clear statement (e.g., by email or letter).

Timely dispatch of the withdrawal notice is sufficient to meet the deadline.

Consequences of withdrawal

In the event of a valid withdrawal, all payments received will be refunded within 14 days. Delivery costs will only be refunded if the item differs from the description.

The refund will be issued using the same payment method used for the original transaction.

The buyer bears the direct costs of returning the goods.

Compensation is only payable if the diminished value of the goods is due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Lux Relife may refuse to issue a refund until the goods have been returned or proof of return has been provided.

IV. Prices and Payment Terms

  1. All prices are in euros.

  2. If differential taxation applies in accordance with Section 25a of the German Value Added Tax Act (UStG), VAT will not be shown separately on the invoice.

  3. Available payment methods are displayed in the online shop.

  4. Lux Relife reserves the right to exclude certain payment methods.

  5. Payment is generally due in advance unless otherwise agreed.

  6. The purchase price is due immediately upon conclusion of the contract.

  7. The goods remain the property of Lux Relife until full payment has been received.

V. Set-off and rights of retention

A set-off is only permissible with claims that have been legally established or are undisputed.

A right of retention may only be exercised to the extent that it is based on the same contractual relationship.

VI. Shipping and Delivery

  1. Shipping occurs after payment is received.

  2. Delivery is handled by DHL, UPS, FedEx, or similar shipping providers.

  3. Shipping costs are displayed to the customer during the order process.

  4. The buyer is obligated to report any obvious transport damage immediately.

  5. Customs duties, import fees, and handling charges for international shipments are the responsibility of the buyer.

  6. All products may be marked with security seals or identification numbers. Removed or damaged seals may void any return or warranty claims.

VII. Commission business

Unless otherwise agreed, sales are conducted on a consignment basis in Lux Relife’s own name but on behalf of the consignor.

In accordance with Section 384 of the German Commercial Code (HGB), Lux Relife is obligated to provide the consignor with the buyer’s details upon request.

By concluding this contract, the buyer agrees to these terms.

VIII. Warranty

  1. The statutory warranty rights apply.

  2. For used goods, the warranty period for consumers is 12 months from delivery.

  3. For businesses, the warranty for used goods is excluded to the extent permitted by law.

  4. Businesses are obligated to inspect the goods immediately upon receipt and report any obvious defects in writing.

IX. Non-availability of the goods

Should an item become unavailable after the contract is concluded, and this is beyond Lux ​​Relife’s control, Lux Relife reserves the right to withdraw from the contract.

Any payments already made will be refunded immediately.

X. Customer account

  1. Creating a customer account may be required for certain website features.

  2. Customers must be of legal age and have the capacity to enter into contracts.

  3. Login credentials must be kept confidential.

  4. Lux Relife must be notified immediately in case of misuse.

XI. Intellectual Property

All content on this website, in particular texts, images, logos, and designs, is protected by copyright.

Use without the express permission of Lux Relife is prohibited.

XII. Differential Taxation pursuant to Section 25a of the German Value Added Tax Act (UStG)

Unless otherwise stated, the goods offered are used items.

Delivery may be subject to differential taxation pursuant to Section 25a of the German Value Added Tax Act (UStG). In such cases, value added tax will not be shown separately.

XIII. Final Provisions

  1. The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  2. If the customer is a business, the place of jurisdiction is the registered office of Lux Relife.

  3. Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

  4. Lux Relife reserves the right to amend these Terms and Conditions at any time.
